General Terms and Conditions of DirtySox GmbH

§1 Applicability to businesses and definitions of terms

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

(2) ‘Consumer’ within the meaning of these terms and conditions is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or self-employed professional activities.

§2 Formation of a contract, storage of the contract text

(1) The following provisions regarding the conclusion of contracts apply to orders placed via our online shop www.dirtysox.cc.

(2) Where a contract is concluded, the contract shall come into effect

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a contract of sale.

Acceptance of the offer shall be made in writing or in text form, or by dispatch of the ordered goods within one week. If this period expires without result, the offer shall be deemed to have been rejected.

(4) Upon receipt of an order via our online shop, the following provisions apply: The consumer makes a binding offer to enter into a contract by successfully completing the ordering process provided in our online shop.

The ordering process consists of the following steps:

1) Select the desired product
2) Confirm by clicking the ‘Order’ button
3) Checking the details in the shopping basket
4) Clicking the ‘Proceed to checkout’ button
5) Log in to the online shop after registering and entering your login details (email address and password).
6) Check the data entered again and correct it if necessary.
7) Binding submission of the order.

Before submitting the order in a binding manner, the consumer may, by clicking the ‘Back’ button in the webto return to the webpage where the customer’s details are entered and correct any input errors, or cancel the ordering process by closing the web browser. We will immediately confirm receipt of the order by means of an automatically generated email (confirmation of receipt). This does not yet constitute acceptance of the offer. Acceptance of the offer shall be made in writing, in text form or by dispatch of the ordered goods within one week.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order details and our Terms and Conditions by email. You can also view the Terms and Conditions at any time at www.dirtysox.cc/Information/Geschaeftsbedingungen . You can view your previous orders in our customer area under My Account --> My Orders.

§3 Prices, delivery charges, payment, due date

(1) The prices quoted include statutory VAT and other price components. Any delivery charges will be added to this.

(2) The consumer may pay via PayPal, MasterCard, Visa, Apple Pay, Google Pay or Klarna Sofortüberweisung.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for immediate dispatch.

§5 Retention of title

We retain title to the goods until the purchase price has been paid in full.

§6 Right of withdrawal

You may withdraw from this contract within 30 days without giving any reason, either in writing (e.g. by letter, fax or email) or – if the goods have been delivered to you before the expiry of this period – by returning the goods. The period begins upon receipt of this notice in writing, but not before the goods have been received by the recipient (in the case of recurring deliveries of goods of the same type, not before receipt of the first partial delivery) nor before we have fulfilled our information obligations under Article 246(2) in conjunction with Section 1(1) and (2) of the Introductory Act to the German Civil Code (EGBGB), as well as our obligations under Section 312g(1), first sentence, of the German Civil Code (BGB) in conjunction with Article 246(3) of the EGBGB. To meet the withdrawal deadline, it is sufficient to dispatch the notice of withdrawal or the goods in good time.

Consequences of withdrawal

In the event of a valid withdrawal, the benefits received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return the goods received and any benefits derived (e.g., benefits of use), or can do so only in part or only in a deteriorated condition, you must compensate us for the loss in value to that extent. You are only required to pay compensation for the deterioration of the goods and for any benefits derived to the extent that such benefits or deterioration result from handling the goods in a manner that goes beyond the examination of their properties and functionality. ‘Checking the properties and functionality’ refers to testing and trying out the goods in question, as is possible and customary in a high-street shop, for example.

Items suitable for parcel post must be returned at our risk. You must bear the standard costs of the return if the goods delivered correspond to those ordered. Otherwise, the return is free of charge for you. Items that cannot be sent by parcel post will be collected from your address. Obligations to refund payments must be fulfilled within 30 days. The period begins for you when you dispatch the item, and for us when we receive it.

§7 Contractual provisions regarding return costs in the event of withdrawal

Should you exercise your right of withdrawal, the following agreement applies in accordance with Section 357(2) of the German Civil Code (BGB), under which you are required to bear the standard costs of returning the goods if the goods delivered correspond to those ordered.

Otherwise, returns are free of charge for you.

§8 Language of the contract

German is the sole language available for the contract.
